Update on title claim court case
18 November 2024
FREDERICTON (GNB) – The provincial government provided an update today on the Wolastoqey title claim.
The Court of King’s Bench issued a decision last week on some preliminary motions in the case.
“The court’s decision was helpful in reminding us that Aboriginal title is primarily about reconciliation,” said Justice Minister and Attorney General Rob McKee. “The decision also emphasized that title claims are best discussed at the negotiation table versus a courtroom, which our government agrees with.”
The Office of the Attorney General has instructed lawyers representing the provincial government in most litigation involving questions of Aboriginal title or treaty rights to engage with lawyers on the opposing side and seek consent to pause all litigation while the Crown and First Nations pursue negotiated settlement of all claims.
“Our government is committed to rebuilding relationships with First Nations based on a nation-to-nation relationship that establishes trust and a shared understanding of treaty obligations,” said Indigenous Affairs Minister Keith Chiasson.
As part of the government’s ongoing commitment to truth and reconciliation, government employees have been invited to use a land acknowledgement at formal meetings, at events, in publications and in other government venues and settings.
