As big timber counsel calls out an ‘abuse of process,’ Indigenous nation lawyers argue seeking formal notice of pending litigation is only fair

SAINT JOHN, N.B. — Legal jousting has begun in earnest in a massive title claim that the Wolastoqey Nation has filed for its traditional territory, more than half of New Brunswick.

Lawyers for the Indigenous nation, seven big tree-cutting companies and their subsidiaries, NB Power, the province and Ottawa were in the Saint John Court of King’s Bench on Monday and Tuesday to argue over an amended statement of claim filed Sept. 13 in the case.

The case is already two years old and is expected to last years more, if not a decade or longer, given what’s at stake.

Two of the companies in the dispute warn they could be driven out of business and the hundreds of jobs they support would be lost.

The lawyers for the Wolastoqey say they want to have back what is rightly and legally theirs after being dispossessed by settlers over more than two centuries.
